The Appeals Process

We will, most likely, take the following steps to start an appeal:

01.

Notice of appeal

First, a Notice of appeal should be filed with your criminal court, within 30 days of the conviction date. If outside the 30 days we can file an extension of time to file appeal .

02.

Payment of fine

Court documents must include evidence of payment of the outstanding fine associated with the conviction.

03.

Transcripts of Proceedings

Additionally, if a trial was held, transcripts of the proceedings should be ordered and attached to the appeal.

04.

Written Argument

It may be necessary to prepare a written argument of the flaws that occurred during trial and file it with the appeals court.

Lesser penalty

Amend the conviction to a lesser offence or penalty.

Change the sentence

Reducing or changing the sentence imposed by the conviction.

Quashed conviction

The person may be completely cleared of the conviction.

Order a new trial

In some instances, the judge may order a completely new trial.
